On land security as the base layer.

In natural-resource positions, every later dispute traces to a contestable base. Securing the base is the discipline that compounds.

Most frontier natural-resource failures are described after the fact as political, operational, or commercial. On examination, the majority are base-layer failures — land, permit, or community consent — that were contestable at the start and propagated their contest upward through every subsequent layer of the position.

A natural-resource position is a stack. Title and surface rights sit at the base. Permits sit above. Community consent rests on both. Commercial terms and operations sit on the consent. When the base is clean, the stack is durable. When the base is contestable, every layer above inherits the contest — political exposure, renegotiation pressure, cost-of-capital dispersion, and ultimately the loss of the position.

Kenyan land tenure is layered — ancestral, registered, state, and trust systems overlap; title is sometimes a claim rather than a record; surface and mineral rights follow different registers. A resource position whose title is contestable does not resolve its contest through operations. It amplifies it. The firm treats base-layer diligence not as one item in a checklist but as the precondition for every other diligence line being meaningful.

The discipline is expensive. Securing the base privately, before capital commits, typically requires local counsel, community engagement, and time measured in months rather than weeks. It is also the single most compounding discipline the firm maintains. Positions that pass the base-layer audit are priced on their economics; positions that do not are priced on their optionality to fail.

Most of the resource capital in the region is deployed without this discipline. A meaningful share returns a fraction of committed cost. The fraction is almost always attributable to the layer no one audited.
